प्रस्तावना : अपराधजन्य कार्यबाट प्राप्त सम्पत्ति सुद्दिकरण गर्ने कार्यलाई निवारण गर्ने संबन्धमा कानुनि व्यवस्था गर्न वान्छनीय भएकाले, व्यवस्थापिका- संसदले यो ऐन बनाएको छ |

३. सम्पत्ति सुद्दीकरण गर्न नहुने:
3. Assets not to Be Laundered:
(१) कसैले पनि सम्पत्ति सुद्दिकरण गर्न गराउन हुदैन |
(1) Nobody shall launder or cause to launder
assets.
(२) कसैले उपदफा (१) बमोजिमको कार्य गरेमा यस ऐन बमोजिमको कसुर गरेको मानिनेछ |
(2)Any one committing acts pursuant to sub-section (1) shall be
deemed to have committed offence as per this Act.

४. सम्पत्ति सुद्दिकरण गरेको मानिने:
कसैले कर छल्ने वा आतंककारी क्रियाकलापबाट आर्जन वा त्यस्तो क्रियाकलापमा लगानी गर्ने कार्य वा देहाय बमोजिमका कुनै वा सबै कसुर गरि प्रत्यक्ष वा अप्रतक्ष रुपमा प्राप्त गरेको, धारण गरेको, भोगचलन गरेको वा प्रयोग गरेको सम्पत्ति र त्यस्तो सम्पत्ति कुनै प्रकारबाट लगानी गरि प्राप्त गरेको वा भएको वा बढे बढाएको सम्पत्ति लाई कानुनि रुपले प्राप्त गरेको, आर्जन गरेको सम्पत्तिको रुपमा भोग चलन गरेमा, धारण गरेमा वा प्रयोग गरेमा, उपयोग वा उपभोग गरेमा वा देखाउने कार्य वा अन्य कुनै पनि कार्य गरेमा वा त्यस्तो सम्पत्तिको स्रोत लुकाउने वा त्यस्तो सम्पत्ति प्राप्त गर्ने व्यक्तिलाई कानुनि कारवाहीबाट बचाउने उद्देस्यले त्यस्तो सम्पत्ति रुपान्तरण गर्न, लुकाउन वा स्थानान्तरण गर्न कसैलाई मद्दत गरेमा सम्पत्ति सुद्दिकरण गरेको मानिनेछ |
4. Assets Supposed to Have Laundered: Assets shall be supposed to have laundered in case anyone, directly or indirectly, earns from tax evasion or terrorist activities or invests in such activities or acquires, holds, possesses or utilizes assets by committing any or all offences stipulated as follows and in case assets acquired, held or accumulated from investment of such assets is possessed, held or used, utilized or consumed or committed any other act so as to present such assets as legally acquired or earned assets or conceals sources of origin of such assets or assists any one to transform, conceal or transfer such assets with an objective of avoiding legal actions to the person having such assets:-,
(क) हातहतियार खरखजाना सम्बन्धि प्रचलित कानुन अन्तर्गतको कसुर,
(a) Offences under the prevailing arms and ammunitions laws,
(ख) विदेसी विनिमय नियमित गर्ने सम्बन्धि प्रचलित कानुन अन्तर्गतको कसुर,
(b) Offences under the prevailing foreign exchange regulation laws,
(ग) ज्यान, चोरि, ठगि, किर्ते कागज, खोटा चलन, अपहरण वा शरीर बन्धक सम्बन्धि प्रचलित कानुन अन्तर्गतको कसुर,
(c) Offences of murder, theft, cheating, forgery documents, counterfeiting, kidnap or abduction under the concerned prevailing laws,
(घ) लागु औसधि नियन्त्रण सम्बन्धि प्रचलित कानुन अन्तर्गतको कसुर,
(d) Offences under the prevailing drug addiction control laws,
(ङ) राष्ट्रिय निकुन्ज तथा वन्य जन्तु संरक्षण सम्बन्धि प्रचलित कानुन अन्तर्गतको कसुर,
(e) Offences under the prevailing national park and wild animals conservation laws,
(च) मानव बेचबिखन तथा ओसारपसार नियन्त्रण सम्बन्धि प्रचलित कानुन अन्तर्गतको कसुर,
(f) Offences under the prevailing human trafficking and taking of hostages control laws,
(छ) सहकारी सम्बन्धि प्रचलित कानुन अन्तर्गतको कसुर,
(g) Offences under the prevailing cooperatives laws,
(ज) वन सम्बन्धि प्रचलित कानुन अन्तर्गतको कसुर,
(h) Offences under the prevailing forest laws,
(झ) भ्रस्टाचार निवारण सम्बन्धि प्रचलित कानुन अन्तर्गतको कसुर,
(i) Offences under the prevailing corruption control laws,
बैंक तथा वित्तीय सस्था सम्बन्धि प्रचलित कानुन अन्तर्गतको कसुर,
(j) Offences under the prevailing bank and financial institution laws,
(ट) बैंकिंग कसुर तथा सजाय सम्बन्धि प्रचलित कानुन अन्तर्गतको कसुर,
(k) Offences under the prevailing banking crime and punishment laws,
(ठ) प्राचीन स्मारक संरक्षण सम्बन्धि प्रचलित कानुन अन्तर्गतको कसुर,
(l) Offences under the prevailing ancient monuments conseravation laws,
(ड) नेपाल सरकारले नेपाल राजपत्रमा सूचना प्रकाशन गरि तोकेको अन्य कुनै कानुन अन्तर्गतको कसुर,
(m) Other offences that Government of Nepal prescribes by
publishing in the Nepal Gazette.

स्पस्टिकरण: यस दफाको प्रयोजनको लागि कसैले देहायका कुनै महासन्धि अन्तर्गतका कुनै कसुर मानिने कार्य गर्ने वा कुनै व्यक्तिको ज्यान लिने वा अंगभंग गर्ने उदेश्यले वा त्यस्तो कसुर वा कसुर गर्ने कार्यमा रकम खर्च हुन्छ भन्ने थाहा पाई वा थाहा पाउनुपर्ने मनाशिब कारण भई कुनै पनि तरिकाले कुनै रकम प्रदान गरेमा वा संकलन गरेमा निजले आतंककारी क्रियाकलापमा लगानी गर्ने कार्य गरेको सम्झनु पर्छ |
Clarification: For the purpose of this section, in case any one has
committed any act supposed to be an offence under the following
conventions or provided or collected any money by any means for
murdering or physically disabling any other knowingly or with grounds that such money is being used for committing such offence, he shall be supposed to have invested in terrorist activities:-
(१) सन् १९६३ मा सम्पन्न वायुयानभित्र भएका कसुर तथा अन्य केहि कार्य सम्बन्धि तोकियो महासन्धि
(1) Tokyo Convention on Offences and Certain Other Acts Committed on Board Aircraft, 1963,
(२) सन् १९७० मा हेगमा सम्पन्न भएको वायुयानको गैरकानुनी कब्जाको दमन सम्बन्धि महासन्धि,
(2) Hague Convention for the Suppression of Unlawful Seizure of
Aircraft, 1970,
(३) सन् १९७१ मा मन्त्रियलमा सम्पन्न भएको गैर सैनिक हवाई उडानको सुरक्षाको विरुद्द गरिने गैर कानुनि कारबाहीको दमन सम्बन्धि महासन्धि,
(3) Montréal Convention for the Suppression of Unlawful Acts Against the Safety of Civil Aviation, 1971,
(४) सन् १९७३ मा सम्पन्न भएको कुटनैतिक प्रतिनिधि लगायत अन्तरास्ट्रिय रुपमा संरक्षित व्यक्तिहरु विरुद्दको अपराध निवारण तथा सजाय सम्बन्धि महासन्धि,
(4) Convention on the Prevention and Punishment of Crime Against Internationally Protected Persons Including Diplomatic Agents, 1973,
(५) सन् १९७९ मा सम्पन्न शरीर बन्धक लिने विरुद्दको महासन्धि,
(5) International convention Against the Taking of Hostages, 1979,
(६) सन् १९८७ मा सम्पन्न आतंकवादको दमन सम्बन्धि सार्क क्षेत्रीय महासन्धि,
(6) SAARC Regional Convention on Suppression of Terrorism, 1987,
(७) आतंकबादी काम कारबाहीको विरुद्दका नेपाल पक्ष भएको अन्य कुनै महासन्धि |
(7) Any Convention against Terrorist Activities to which Nepal is a party.
५. उद्द्योग, मद्दत वा दुरुत्साहन गर्न नहुने: कसैले पनि यस परिच्छेद बमोजिमको कसुर गर्ने उद्द्योग गर्न, मद्दत गर्न वा दुरुत्साहन गर्न हुदैन |
5. Not to Attempt, Support or Provoke: No one should attempt, support or provoke others to commit offences stipulated in this chapter.
